Healing Touch Program (HTP) Terms of Use
 
The following terms and conditions (together with any documents referred to in them) (collectively, these "Terms of Use") apply to your use of any and all websites owned and operated by Healing Touch Program (HTP). This includes Healing Touch Program (HTP), Healing Touch Professional Association (HTPA), Healing Touch Certification (HTC) and Healing Touch Integrative Care Program (ICP).  By using these websites, you accept and agree to be bound by these Terms of Use and our Privacy Policy incorporated herein by reference. If you do not agree to these Terms of Use or the Privacy Policy, please do not use these websites.

General
 
These websites (the “Sites”) are owned and operated by HTP, (“We” or “Us”). By using these Sites, you agree to be bound by these Terms and Conditions of Use and Service (“Terms and Conditions”) and to use the Sites in accordance with these Terms of and Conditions and Service, Privacy Policy, and Refund Policy. These Terms and Conditions are in addition to the terms and conditions that may apply to specific sections of the Sites or to products and services available through the Sites or from HTP/HTPA/HTC/ICP. Accessing these Sites, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms and Conditions.
 
 
HTP may, at any time, revise or modify these Terms of Use or impose new conditions for use of these websites. Such changes, revisions or modifications shall be effective immediately upon notice to you, which may be given by any means including, without limitation, posting on the website or by email. Any use of the websites by you after such notice shall be deemed to constitute acceptance of such changes, revisions or modifications. HTP may modify these websites and its services at any time.
 
 
Scope of Use
 
HTP grants you a limited license to access and make personal use of these websites only for lawful purposes and in accordance with these Terms of Use. Unless indicated to the contrary, you may access, copy, download and print the content available on this websites (including, without limitation, text, design, graphics, logos, icons, images, audio clips, downloads, interfaces, code and software) for your personal, non-commercial use, provided you do not modify or delete any copyright, trademark or other proprietary notices that appear in the content. Except as otherwise provided in these Terms of Use, no part of any content on these websites may be copied, downloaded or stored in a retrieval system for any other purpose, nor may it be redistributed for any purpose, without the express written permission of HTP. You understand that HTP may discontinue, change, or restrict your use of these websites for any reason without notice.
 
 
By using these websites, you represent that you are at least eighteen (18) years old.
 
 
User Submissions
 
Certain areas of these websites contain personal web pages or profiles, forums and other interactive features that allow you to submit, post, or transmit to other users (hereinafter, “submit”) content on or through the website(s). You acknowledge that you are responsible for any content you submit on or through the website(s), including its legality, reliability, accuracy and appropriateness.
 
 
You agree that by submitting content:
  •  The content is your original work, you own the content or you have permission from the owner of the content to submit such content to the website(s);

Any content and/or opinions posted to the website(s), and all articles and responses to questions and other content, other than the content provided by HTP, are solely the opinions and the responsibility of the person or entity submitting them and do not necessarily reflect the opinion of HTP. HTP is not responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the website(s). 
 
HTP has the right to remove or refuse to post any user content for any or no reason in our sole discretion. However, HTP cannot review all material before it is posted on the website(s), and cannot ensure prompt removal of objectionable material after it has been posted. Accordingly, we assume no liability for any action or inaction regarding transmissions, communications or content provided by any user or third party.
 
Access to  Member Services, Website User Portals and Termination of Access: 
In order to obtain access to the Member Service/User Portal portions of our website(s), you must be a current member and insert your user name and password. You agree that you will be responsible for maintaining your user account as confidential and for any activity that occurs as a result of your enabling or permitting another person or entity to use your account. You agree to  immediately notify us in the event that (i) your account is lost or 
stolen, or (ii) you become aware of any unauthorized use of your  account or of any other breach of security that might affect the Website. HTP is not responsible for any loss or damage arising from your failure to comply with the provisions of this Paragraph. 
 
You acknowledge and agree that HTP may terminate your access  privileges and remove and discard any content without notice to you for any reason, including without limitation, if (i) HTP believes that you have violated any provision of this Agreement, and/or (ii) you have otherwise acted or failed to act in any manner that HTP deems objectionable. You agree that any termination of your access to the website(s) shall not result in any liability or other 
obligation of HTP to you or any third party in connection with  such termination.
 
Intellectual Property
these websites and its content are protected by copyright, trademark and other applicable United States and international laws. These websites include proprietary information and material, including graphics, audio/video clips, and editorial content, that is exclusively owned by HTP. This information is protected by all applicable intellectual property laws, including but not limited to trademark and copyright laws. As a condition of your access to these sites, you agree to not use any such proprietary information without the express written consent of HTP.
 
 
Refunds and Fees
Refunds for the HTP are strictly governed by the Terms and Conditions set forth upon enrollment in our programs and membership. Except where expressly stated, nothing in these Terms and Conditions modifies or otherwise alters those provisions.
 
 
Healing Touch Class Refund Policy:
 
Healing Touch Program (HTP) Satisfaction Guarantee
Healing Touch Program classes come with a 100% satisfaction guarantee. If you fully participate in and complete an entire Healing Touch class and take 10 days to use the Healing Touch skills that you learned on yourself or another, and find that you have not received any value and cannot positively influence your life with the Healing Touch techniques and principles you learned in the class, you may request a refund of your tuition according to this refund policy.
 
HTP Class Instruction: All HTP classes are taught by a Healing Touch Certified Instructor (HTCI) who is certified and authorized to teach the class. Classes are sponsored in two ways:
 
   1. HTP Sponsored Class where HTP handles all class logistics and hires an HTCI to teach the class.
   2. Independent Class where the HTCI handles all class logistics and teaches the class.
 
Independent Classes
Independent HTP classes are sponsored and offered by Healing Touch Certified Instructors (HTCIs) to provide authorized training in the HTP classes. These classes are offered independent of HTP and are provided under agreement with HTP and according to the HTP class guidelines. The Independent instructor is responsible for the financial administration of their independent classes, including class refund policies.
 
 
Independent Class Refund Policy
Cancellation and refund policies are at the discretion of the Independent Instructor for their classes. No student refunds for Independent Classes will be given by HTP. Cancellation and refund policies for Package students are described in the Package Cancellations section.
 
 
HTP Sponsored Class Registration and Payment Policy
Registration includes a Tuition cost and may include a Room and Board or Retreat Center cost. All payments will be applied to the total amount due for the class. Classes must be paid in full or be participating in an HTP payment plan two weeks prior to the start date of the class or the students may be withdrawn and refunded.
 
 
HTP Sponsored Class Cancellations Requests
Cancellation requests by the student must be in writing, be received two weeks prior to the class start date and must contain the registrant's name, address, phone, email, class dates and location. Cancellations should be emailed to [email protected], or mailed to the HTP office 15439 Pebble Gate, San Antonio, TX 78232. HTP Sponsored Class Refund Payments
For payments made to HTP via credit card within the previous 90 days, the refund will usually be in the form of a credit to the same card. Refunds will be less any associated fees resulting from the method of payment (i.e. credit card charges) and any materials received. After 90 days, the refund will be paid by check. If the tuition was paid by check, the refund will also be paid by check. HTP will mail refund checks to the registrants address as it appears on the cancellation request.
 
 
HTP Sponsored Class Refund Policy
 
1. Workshop Style Classes (Retreat center lodging not offered) Student cancellations must be made at least 48 hour prior to the start of the class with written notification provided to HTP. A cancellation fee of $100 applies to any class that is registered for and not attended without 48 hours notification prior to the start of the class. Students may still register for another class after the above cancellation fee has been paid.
 
 
2. Retreat Style Classes with required lodging (Level 4 and Level 5 Classes) Class cancellations made prior to two weeks (14 days) before the earlier of either the scheduled class date or the retreat center cutoff date (as noted in your confirmation letter) are eligible for a full refund.
 
For cancellations made after two weeks (14 days) prior to the earlier of the class or retreat center cutoff date, the registrant has a choice between the following options:
 
 
A. Transfer the full tuition to another scheduled class, and pay for any retreat center costs that result from the cancellation or transfer. The rescheduled class must be within one year of the cancellation date.
 
 
B. Receive a refund of the full tuition less a $100 administrative charge plus any charges from the retreat center incurred as a result of the cancellation.
 
 
Cancellations received after the class starting date are subject to forfeit, except in the case of extenuating circumstances. Extenuating circumstances, such as a death in the family, visit to the emergency room, etc. must be submitted in writing and must be approved by HTP.
 
 
Class Package Cancellations
Class Packages are nonrefundable after 30 days from the date of purchase.
 
 
Prior to taking classes you may get a full refund (within 30 days). After taking classes, you may get a refund less the full retail price of any classes taken. A cancellation fee of $100 applies to any class that is registered for and not attended without 48 hours notification to HTP and the instructor prior to the start of the class for level 1-3 classes. A cancellation fee of $200 for less than two weeks cancellation notice for Level 4 and 5 classes.
 
Students may still register for another class after the above cancellation fee has been paid.
 
 
Cancellation/Rescheduling of HTP Sponsored Classes
HTP reserves the right to reschedule or cancel any class or related event(s) in our sole discretion. In the event that HTP cancels or reschedules a class, the student may transfer and apply the class tuition and any room and board costs paid to HTP to another scheduled HTP class or may request a full refund of the class tuition and room and board paid. HTP is not responsible for, and will not reimburse, travel costs including airline tickets, hotels costs (other than HTP provided room and board costs), or any other costs or expenses the registrant may incur as a result of the cancellation or change. HTP reserves the right to change any instructor for any class or event without notice.
 
 
Healing Touch Program management reserves the right, at its discretion and without explanation, to keep a person from registering for a class or to require a participant to leave a class. Any refunds will be handled on a case by case basis by the discretion of the management team.
 
 
Product Returns:
All physical items being returned must be complete of all parts and accessories (if applicable), and be in original and unused condition. The item(s) being returned must be shipped back to HTP within thirty (30) days of the date of delivery. You are free to select the postal courier of your choice and you are responsible for return shipping costs. If all of these conditions are satisfied, HTP will refund the value of the returned item(s) in US Dollars, sales tax included, less our original shipping costs. We will not issue any refunds for returns that do not satisfy all of the conditions indicated above; provided, however, that you will have the option to request within thirty (30) days of being notified that you are not entitled to a refund that the item(s) be shipped back to you, at your own cost (you pay the return shipping costs), in the condition in which the item(s) were received by HTP.
 
 
Because we want to maintain the highest level of customer satisfaction and constantly improve our products and programs wherever possible, we may seek input from customers who have submitted a refund request through a short telephone call to understand why the refund was requested.
 
HTPA Membership Refunds
Refunds are available based on the remainder of your membership year. If a refund is applicable, it will be issued in the form of a credit back to the same payment method used to make the original purchase on the Site less any associated fees resulting from the method of payment (i.e. credit card charges).
Insurance bought through your HTPA membership: once your insurance application has been approved we are unable to offer any refunds on your insurance policy or HTPA membership. The insurance issues you a certificate which is good for the entire period of time specified on it, so refunds are not available for this insurance. 
 
Healing Touch Certification Refunds
Payment is processed at the time of registration for the certification application being submitted. Most applications have a non-refundable application feeas either a portion of or the entire payment. The application fees, including the non-refundable portion, are listed in the application packet you download and are subject to change without notification. If a refund is applicable, it will be issued in the form of a credit back to the same payment method used to make the original purchase on the Site less any associated fees resulting from the method of payment (i.e. credit card charges). The time that it takes for a refund credit to appear on your account may vary based on the form of payment used.
 
Healing Touch Integrative Care Refunds
Any Healing Touch class refunds will follow the Class Refund Policy as listed above. Any services contracted by HTICP may receive applicable refunds according to the contract between HTICP and the organization/individual receiving the service. Any refund that would be issued in the form of a credit back to the same payment method used to make the original purchase less any associated fees resulting from the method of payment (i.e. credit card charges). 
 
 
 
Privacy Policy
All information we collect on these websites is subject to our Privacy Policy. By using the website(s), you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.

HTP provides links to other websites as a convenience to users, and access to any other sites linked to this website is at your own risk. Such linked websites are not under the control of HTP, and HTP is not responsible or liable for any loss or damage that may arise from your use of them. Links to other websites do not imply HTP's endorsement of any content, advertising, products or other materials on or available from such sites.
 
 
Unless otherwise set forth in a written agreement between you and HTP, you must adhere to HTP's linking policy as follows: (i) the appearance, position and other aspects of the link may not be such as to damage or dilute the goodwill associated with HTP's names and trademarks, (ii) the link must "point" to the root domain name of the HTP website and not to other pages within the website, (iii) the appearance, position and other attributes of the link may not create the false appearance that your organization or entity is sponsored by, affiliated with, or associated with HTP, (iv) when selected by a user, the link must display the website on full-screen and not within a "frame" on the linking website, and (v) HTP reserves the right to revoke its consent to the link at any time and in its sole discretion.

HTP is based in the state of Texas in the United States. Those who choose to access these websites from other locations do so on their own initiative and are responsible for compliance with applicable local laws.
 
 
These Terms of Use and any dispute or claim arising out of or related to these Terms of Use, their subject matter or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Texas without giving effect to any choice or conflict of law provision or rule. Any legal suit, action or proceeding arising out of or related to these Terms of Use or the website(s) shall be instituted exclusively in the federal or state courts located in San Antonio, Texas. You agree to waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
 
 
Violations
HTP reserves the right to seek all remedies available at law and in equity for violations of these Terms of Use, including without limitation the right to block access from a particular Internet address to the website(s) and to refer any illegal or unauthorized use of the website to law enforcement.
 
 
Waiver and Severability
No waiver of these Terms of Use by HTP shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure of HTP to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
 
If any provision of these Terms of Use is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms of Use will continue in full force and effect.
